Healthcare Provider Terms of Use

This Virtual Practice is a web and mobile based system to be used by the members of Dr-Online's healthcare provider team (including healthcare providers, support and administrative personnel) whom Dr-Online authorizes to use the system, henceforth referred to as 'Healthcare Providers'. The patients of Dr-Online have dedicated patient interfaces to use this Virtual Practice and their usage of the system is covered by the Patient Terms of Use. The use of the Virtual Practice by Healthcare Providers is bound by these Healthcare Provider Terms of Use.

If you do access this Virtual Practice, you shall be deemed to confirm your acceptance of these Healthcare Provider Terms of Use and your agreement to be a party to this binding contract. As our service offerings evolve, other terms or conditions may be presented by Dr-Online and accepted by you in connection with this (all of which we collectively refer to as the 'Terms of Use' or 'Terms'). If you do not agree to these Terms, you do not have the right to access or use the Virtual Practice service.

Changes in the Healthcare Provider Terms of Use can also be expected to happen due to changes in laws and/or conditions applicable to Dr-Online. We will announce changes here at our site, and we also may elect to notify you of changes by sending an email to the address in your authorized user account. You are free to decide whether to accept the updated terms or to stop using our Virtual Practice; your continued use of the Virtual Practice after the effectiveness of that update will be deemed to represent your agreement with, and consent to be bound by, these aforementioned terms.

Your Virtual Practice User Account

Provisioning of an authorized Healthcare Provider account is limited to licensed healthcare providers and authorized employees of Dr-Online only. Your user account is expected to include your full name, valid email address and valid mobile phone number. The activation of your user account is subject to the verification of your email address. Your name, email address, phone number and secure password are referred to as your Account Information. Dr-Online maintains the right to create, disable and/or delete Healthcare Provider user accounts.

If you are a healthcare practitioner, all details of your professional qualifications, experience, expertise and services as a healthcare provider are referred to as your Profile. You are completely responsible for the accuracy and validity of details provided in your Profile. Account Information should be securely maintained and not be shared with anyone. We will not bear any liability to you or to anyone impacted by your sharing of your Account Information. If you discover or suspect any unauthorized use of your Account Information you should immediately change your password and notify our administrative team (contact@dr-online.ro).

Acceptable Usage Policy

This Acceptable Use Policy sets out a list of acceptable and unacceptable conduct for Healthcare Provider users in this system. Any violation of the policy could result in the suspension or termination of a user's access to the Virtual.

  • The username and password of Healthcare Provider users are unique to each user, and each user agrees not to disclose or share their username and password to or with any third party. Users are responsible for keeping their password confidential and for notifying Dr-Online immediately if the user's password has been hacked or stolen.
  • Healthcare Provider users agree that you will be solely responsible for any activities conducted through the applications of this system with the user's account regardless of whether or not the user is the individual who undertakes such activities. This includes any unauthorized access and/or use of the user's account or computer.
  • All Healthcare Provider users acknowledge and agree that the form and nature of the services provided by the system may change from time to time, features may be added, improved or changed without prior notice.
  • The Healthcare Providers of this system shall not attempt to circumvent any security measure nor attempt to gain unauthorized access to any services, user accounts, or computer systems or networks owned and/or controlled by Dr-Online, through hacking, password mining or any other means.
  • Healthcare Provider users shall not upload or submit any data or information containing viruses or any computer code, corrupt files or programs engineered or intended to disrupt or destroy the functionality of any software, hardware, telecommunications, networks, servers or other equipment.
  • Healthcare Provider users unconditionally agree to receive certain essential automated SMS, mobile, email and WhatsApp notifications relevant to system events from the system, its apps and services to the mobile number and email address associated with the user account, irrespective of whether the user has subscribed to any Do-Not-Disturb (DND) services. Settings to turn off WhatsApp notifications are available.
  • Healthcare Provider users may not export, copy or share data from the system, including patient health data, administrative data or data of any kind.
  • Patient data should not be used for any unauthorized and/or unethical purposes. It may not be copied, shared or distributed without written authorization of the patient. This applies to all associates and employees of Dr-Online authorized to access this system.
  • As a user of Dr-Online you agree that general media files required in the applications may be served to your devices used to access the applications.
  • As a user you may not use automated tools on our applications without our consent, nor cause any degradation of our application services. You may not compromise the privacy and security of any user data, nor cause its modification, misuse or destruction in any way.
  • As a user, you will not use malware or engage in phishing activities to compromise the security of our applications and services.

Data Policy

Patients and Healthcare Providers of Dr-Online may submit information and content through the web and mobile applications of the Virtual Practice, including data such as PHI (patient health information), healthcare services related data, communications and usage data, all of which qualifies as 'Customer Data' and is owned by Dr-Online.

The Healthcare Providers in the Virtual Practice have access to view and update healthcare data of patients in the course of providing them with healthcare services. Patients are authorized to view and update their own health data, except for specific areas that you choose not to make visible/accessible to them. Ownership of and responsibility for healthcare data of patients in this system rests solely with Dr-Online.

Operations Data: In order to enhance your usage experience, the application uses cookies, server logs and other similar mechanisms to enable certain functionality, improve services and monitor service usage.

Cookies are used to save user preferences, preserve session settings, help auto-authentication of frequently used services if required by your settings and to enable other similar functional requirements. You may use browser settings to disable cookies when using our web services, however it may result in some of the features and services of this application not functioning properly. The only third-party cookies used by the application are AWS (Amazon Web Services) load balancer cookies required for functioning of this cloud based application. These cookies have a one week expiry. The first party cookies used by this application are for security and authentication purposes only and these cookies have session span, except for one which has a one year lifespan.

Responsible Use of Service

Healthcare Providers using the system to provide healthcare services to existing and new patients of Dr-Online are responsible for the treatment, communication, data updates and all interactions through the system between you and your patients.

Text Consultations:When providing answers to patient questions through Text Consultations in this system, it is the responsibility of every healthcare provider to:

  • Adhere to the response times, specified while configuring your service.
  • Insist on the right information from the patient
  • Exercise care while answering questions and ensure that patients not directly consulting with you in person, verify any information with their own doctor
  • Provide the best possible response and cautionary notes while answering
  • Ensure that patients dealing with medical issues of an urgent nature immediately contact their nearest doctor/hospital.
  • Ensure that you are qualified and competent to be handling the Text Consultations

Video Consultations:It is important to meet appointments scheduled for Video Consultations on time. Reminders for the same will be sent to both the patient and healthcare provider and it is important that both sides prepare to be ready in advance of the appointed time. Failure to hold a consultation at the appointed time requires that the patient should be a granted an alternate appointment free of cost and/or that the cost of the Video Consultation be refunded to the patient.

The healthcare provider reserves the right to decide the video consultation duration and also when the consultation ends for any specific consultation instance. This could be earlier or later than the maximum possible duration. If the healthcare provider has to conclude the video consultation mid-way due to a medical emergency, then a new session at an alternative timing will have to be scheduled by the healthcare provider, free of cost to the patient.

The quality of the video session depends on the quality of the Internet connection, web cam and audio facilities of both the patient and healthcare provider. It is the responsibility of the healthcare provider to ensure that the performance and quality of the equipment and connection used, are optimal for doing video calls online. Video Consultations that fail on account of poor equipment and connectivity on the side of the healthcare provider will have to be rescheduled.

It is required that the healthcare provider prepares ahead of time to participate in the Video Consultation, in a quiet and private place, where only the healthcare provider is present in the room where the video session is being held. There must be no audio/video recording of the video session by the healthcare provider, other than video archiving that may be built into the system.

Video Consultations must not be scheduled for patients with critical medical conditions and/or for emergencies. Such consultations are suitable only for basic follow-ups between the patient and doctor and/or preliminary consultation before meeting the healthcare provider in person.

Remote Patient Monitoring:The healthcare provider is responsible for configuring the scope, instructions, description, tracking requirements and applicable pricing if any for remote monitoring plans. The healthcare provider may create general monitoring plans that patients can subscribe or alternatively create custom monitoring plans personalized for individual patients. The healthcare provider is responsible for determining the best approach for each patient or group of patients. The healthcare provider is responsible to review patient updates covered by a remote monitoring plan as per the review frequency defined for the plan. The quality of review and nature of feedback provided to the patient is entirely the responsibility of the healthcare provider. It is also the responsibility of the healthcare provider, to remind and motivate patients to adhere to monitoring requirements.

Usage of Third Party Integrations and Channels

The Virtual Practice may be configured to interface with one or more external systems including but not limited to, external applications, platforms, APIs, and services. All Healthcare Providers (Team Users) of this Virtual Practice are responsible for ensuring that any data transmitted to such integrated channels and services complies with applicable data protection laws, regulations, and contractual agreements. Users shall not transmit sensitive or confidential information especially ePHI to such integrated channels and services unless explicitly permitted and necessary for the intended functionality of the integration. Consent from individuals whose data is being transmitted to integrated channels or services is mandatory. This includes obtaining explicit consent for any direct marketing or other promotional activities.

In the case of API integrations, Healthcare Providers (Team Users) shall implement appropriate security measures to safeguard data during its transmission to integrated services via API. This includes encryption and secure transmission protocols where applicable. Compliance with any security requirements stipulated by integrated services and channels to protect against unauthorized access or data breaches, is mandatory. Healthcare Providers (Team Users) shall regularly monitor the data transmission to integrated channels to ensure that it remains compliant with these terms and any relevant regulations.
